Terms of service
1. Overview
This website is operated by CyberTrigger. Throughout the site, “we”, “us” and “our” refer to Cyber Trigger Pty Ltd, trading as CyberTrigger. These Terms of Service apply to your use of this website and to purchases made through our online store, showroom and other sales channels where these Terms are made available.
By accessing the website, placing an order or using our services, you agree to these Terms and any policies linked from them. If you do not agree, you must not use the website or place an order.
2. Eligibility and lawful use
You must be legally able to make a purchase and meet any age, licence and location requirements that apply to the product. Before ordering, you are responsible for checking that you can legally purchase, receive, possess, transport, store and use the product under the laws that apply in your location. We may ask for identification, licence details or other information before accepting or fulfilling an order. Some products cannot be ordered or delivered to certain locations. Depending on the product and delivery address, your order may be blocked at checkout or cancelled if we cannot verify that it can be supplied lawfully.
3. Product information
We aim to describe and display products accurately. Colours, finishes and other visual details may vary between screens and production batches. Measurements, compatibility information and performance figures are guides unless expressly stated otherwise.
Customers should confirm compatibility before purchasing parts, magazines, accessories or upgrade components. Contact us if you are unsure whether a product is suitable for your platform or intended use.
4. Prices, availability and orders
Prices are shown in Australian dollars and include GST where applicable unless stated otherwise. Delivery charges and other applicable costs are shown before checkout.
Submitting an order does not require us to accept it. We may reject or cancel an order where a product is unavailable, information is incorrect, payment is not authorised, a pricing or listing error has occurred, or we reasonably believe the order cannot be fulfilled lawfully. If payment has already been collected for a cancelled order, we will provide the appropriate refund.
We may limit quantities where reasonably necessary to manage stock, suspected resale activity, fraud or legal supply restrictions.
5. Payment
Payment must be made using a payment method offered at checkout. Payment services may be provided by third parties and may be subject to their own terms and privacy practices. We do not control a payment provider’s approval process.
6. Delivery and local pickup
Delivery availability depends on the product and destination. We may restrict or refuse delivery where a product cannot be supplied to the nominated address. Estimated delivery times are guides and can be affected by carriers, public holidays, weather, stock availability and events outside our reasonable control.
Local-pickup customers must wait for pickup confirmation and may be asked to provide order identification. Risk and responsibility for an order pass as provided by applicable law and the delivery or pickup terms shown at checkout.
7. Returns, refunds, warranties and consumer rights
Returns, refunds and warranty claims are handled under the information published on our website and the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. Any store or manufacturer warranty is additional to rights available under the Australian Consumer Law.
Contact us promptly with your order number and relevant photos, video or other information if a product is faulty, damaged, incorrect or not as described.
8. Workshop, repair and upgrade services
Quotes and estimated completion times for workshop services may change if an inspection identifies additional faults, incompatible components or other work that was not reasonably apparent at the time of the estimate. We will seek approval before carrying out additional chargeable work.
Performance outcomes can depend on the condition and configuration of the customer’s equipment, installed parts, consumables and intended use. We do not guarantee a particular performance result unless it is expressly included in a written quote or service description.
Customers must disclose relevant modifications, faults and previous repair work when requesting workshop assistance.
9. Website accounts and information
You are responsible for keeping account credentials secure and for the accuracy of information submitted through the website. Notify us promptly if you believe an account or order has been used without authority.
We may correct website errors, update information or suspend access where reasonably necessary for security, maintenance, legal compliance or protection of the store and its customers.
10. Prohibited conduct
You must not use the website to break the law, infringe another person’s rights, introduce malicious code, interfere with website security or operation, collect information without authority, submit false information, or attempt fraud or unauthorised transactions.
11. Intellectual property
Unless otherwise stated, website text, graphics, photographs, logos, layout and other original content are owned by or licensed to CyberTrigger. You may use the website for personal shopping and information purposes but must not reproduce, sell, republish or commercially exploit its content without permission.
Third-party product names and trade marks remain the property of their respective owners.
12. Third-party services and links
The website may use or link to third-party services. We are not responsible for third-party websites or services that we do not control. Review their terms and privacy practices before using them.
13. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website or products where that loss was not reasonably foreseeable. This clause does not exclude or limit liability where doing so would be unlawful, including rights and remedies under the Australian Consumer Law.
14. Changes to these Terms
We may update these Terms to reflect changes to the store, services or legal requirements. The version published at the time an order is accepted applies to that order unless applicable law requires otherwise.
15. Governing law
These Terms are governed by the laws of Queensland, Australia. Nothing in this clause prevents a consumer from relying on rights or forums available under applicable law.
